Conditions of Entry




  1. Information and instructions on how to enter form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry.

  1. Entry is only open to residents of Australia. Directors and employees (and their immediate families) of the Promoter, participating outlets and any of their agencies associated with this Promotion are ineligible to enter.


  1. The Promotion commences on 18/01/12 at 00:09.01 (AEDST) and concludes on 08/04/12 at 20:59.59 (AEDST) (“Promotion Period”). Entries must be received during the Promotion Period. Entries will be deemed to be accepted at the actual time of receipt by the Promoter and not at the time sent by the entrant.
  2. To enter, consumers must, during the Promotion Period




  1. Customers can enter as many times as they like.


  1. Illegible, late or incomplete entries will be invalid and therefore ineligible to enter the Promotion or win a prize.

  1. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider that permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

  1. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim any prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  1. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter. This includes, but is not limited to, entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

  1. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account are invalid and will not be accepted.

  1. Prize Draw: The Major Prize Draw will take place at Oxygen Interactive, Level 1, 16 Palmer Parade Cremorne VIC 3121 at 11:00am (AEST) on 11/04/12.

  1. Major Prize: The winner will win a Crusty Demons Pro Z 125 Bandit Off Road Motorbike (“Prize”) valued at $2,100. Total maximum prize pool value in each State is $2,100 (including GST).

  1. Any additional options to the Prize, insurance and all ancillary costs are the responsibility of the winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.

  1. Prizes or any component of a prize cannot be transferred and non-cash prizes cannot be redeemed for cash. The Promoter’s decision is final and no correspondence will be entered into. If a prize, or element of a prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority.

  1. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. By accepting a prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

  1. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

  1. Dollar values are in Australian dollars. Prize values are based upon the recommended retail prices (inclusive of GST) at 21st December 2011. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

  1. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.

  1. The winners will be notified by telephone within 2 business days of the major draw sent a letter advising them of their prize.

  1. Prizes will only be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder). The winner will therefore be, in each case, the account holder.

  1. Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

  1. The Promoter may conduct such further draws as are necessary at the same time and place as the original prize draw on 22/07/12 in order to distribute any prize unclaimed by that date.

  1. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

  1. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) use of the prize.

  1. The Promoter, its agency Oxygen Interactive Pty Ltd and their associated agencies and companies are not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries, and reserves the right to take any action that may be available.

  1. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  1. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition. If the competition is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the competition subject to approval from any relevant authority.

  1. The Promoter may use any information entrants provide in connection with this Promotion for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. The Promoter may disclose the information for those purposes to its related bodies corporate, contractors and agencies. If entrants do not provide the information requested, they will not be able to enter the competition.

  1. The Promoter may also use your electronic data to send further marketing or information services of either the speedway or other services
